3. About our Service
Nabi Music Center.com helps Students connect with independent music instruction providers (Instructors).
We give you job opportunities and manage your business through marketing, scheduling, payment and communication.
We will make you a personalized Profile. This Profile contains a summary of the information you give us at the moment of filling out the Instructors Application Form. Your Profile will be listed on the Website where prospective Students can review it and choose you as their instructor.
We will send you job offers to your email and it is your choice to accept or decline a job offer.
Every week, you will receive a payment via eCheck for the lessons you completed during that week. We will need the email address associated with your bank account in order to process your payment via eCheck.
Acceptance for Profiles on the Website is at our sole discretion and we may remove Profiles from the Website at any time for any reason. Any information you give us when filling out the Instructors Application Form (i) must not breach any agreements you have entered into with anyone, including this Agreement; and (ii) must contain accurate, current and complete information. If you are approved and your Profile is presented on the Website, you must continually comply with this Agreement and the Guidelines. Any Instructor who accepts a job offer through the Service must honor all terms and conditions, this Agreement and our Guidelines in effect at the time of accepting a job offer.
It takes three steps to become an Instructor at Nabi Music Center:
You must fill out the Instructors Application Form.
2) Interview and References: Once your application is approved by our staff, we will schedule an online interview which will take no longer than 30mins. At the same time, we will contact your references to conduct Reference Checks.
3) Profile Agreement. You will receive a hidden link which directs you to your profile page. You need to verify the information on your profile page and complete the Profile Agreement for us to publish your page.
When you accept a job offer, you are hiring us to provide services to you through our network of independent contractors. You acknowledge that Instructors are independent contractors who operate a separate and distinct business from Nabi Music Center. As such, we do not control the manner or method of service to you, exercise no control over the working relationship and do not warrant the service of any Instructor. We urge all users of the Website to be responsible and careful about their use of the Service.
You pay taxes as an individual—there’s no need to register as a business. File taxes as you normally would, and we’ll send you a 1099 form that you will use to report the income you made teaching with Nabi Music Center.
We provide a suitable independent Instructor, different pricing plans, scheduling and billing.
You can choose a particular lesson subject from our Lessons page and also review Instructors’ Profiles without the need of registration; however, if you wish to book a lesson as a Student you must first become a registered Member of the Website.
We offer an online service that facilitates the payment of your lessons.
We demonstrate our care for your safety and security by managing your lessons schedule and the communication between you and your Instructor.
To become a registered Member you must fill our the Student’s Registration Form. After registering you may choose your lesson(s) and submit a payment for your lesson(s). You may also choose your instructor from our Instructor’s Page or we may assign an instructor for you. As a Student Member you must continually comply with this Agreement and these Guidelines.
Lesson prices are agreed to at the time of payment for the number of lessons purchased. Lesson prices vary by lesson type and are subject to change at any time. Student Members and Instructors Members are obligated to honor the prices established at the time of payment. Additional information is available in our Guidelines.
This Agreement will remain in full force and effect while you use the Website and/or are a Member. You may terminate your membership at any time, for any reason, by emailing us at firstname.lastname@example.org. We may terminate your membership by sending a notice to you at the email address you provide in your application or registration, or such other email address as you may later provide to us. If we terminate your membership because you have breached this Agreement, you will not be entitled to any refund of unused subscription fees. All decisions regarding the termination of accounts shall be made in our sole discretion. We are not required to provide you notice prior to terminating your membership. We are not required, and may be prohibited, from disclosing a reason for the termination of your account. After your membership or subscription is terminated, all terms that by their nature may survive termination of this Agreement shall be deemed to survive such termination.
No Student and/or Instructor shall, directly or indirectly, circumvent, initiate, solicit, negotiate, contract or enter into any business transactions with any Student or Instructor introduced by us through the Website or any Service, without our consent. In case of such contact, such Student and/or Instructor agrees to pay a legal monetary penalty that is equal to the commission we would have obtained in such transactions, had Instructor and/or Student not circumvented our rights under this Agreement. Illegal and/or unauthorized uses of the Website may be referred for criminal prosecution. These provisions are valid during the term of this Agreement and for two years thereafter.
7. Members Interactions and Our Limitation of Liability
WE FORBID THE DIRECT OR INDIRECT CONTACT OF OUR MEMBERS WITHOUT OUR CONSENT IN AN ATTEMPT TO SUPPORT AND REINFORCE THE SAFETY AND PRIVACY OF OUR MEMBERS. HOWEVER, YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER MEMBERS. WE MAKE NO REPRESENTATIONS OR WARRANTIES AS TO THE CONDUCT OF MEMBERS OR THEIR COMPATIBILITY WITH ANY CURRENT OR FUTURE MEMBER. IN NO EVENT WILL NABI MUSIC CENTER OR ITS AFFILIATED PARTIES BE LIABLE FOR ANY DAMAGES WHATSOEVER, WHETHER DIRECT, INDIRECT, GENERAL, SPECIAL, COMPENSATORY, CONSEQUENTIAL, AND/OR INCIDENTAL, ARISING OUT OF OR RELATING TO THE CONDUCT OF YOU OR ANYONE ELSE IN CONNECTION WITH THE USE OF THE SITE OR THE SERVICES, INCLUDING WITHOUT LIMITATION, BODILY INJURY, EMOTIONAL DISTRESS, AND/OR ANY OTHER DAMAGES RESULTING FROM (I) INTERACTIONS WITH OTHER USERS OF THE SITE, (II) YOUR RELIANCE ON INFORMATION OR OTHER CONTENT POSTED ON THE SITE OR TRANSMITTED TO OR BY ANY USER OF THE SITE OR SERVICES, AND (III) REVIEWS OR COMMENTS MADE ABOUT YOU ON THE SITE BY OTHER USERS.
8. Content on the Website
The Website contains the copyrighted material, trademarks, and other proprietary information of Nabi Music Center, and its licensors. Except for that information which is in the public domain or for which you have been given written permission, you may not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information.
Reliance on Content, Advice, Etc.
Opinions, advice, statements, reviews, offers, or other information or content made available through the Service or on the Website, but not directly by us, are those of their respective authors, and should not necessarily be relied upon. Such authors are solely responsible for such content.
14. Customer Service
We may provide assistance and guidance through our customer care representatives. Emails between you and our customer care representatives may be monitored for quality assurance purposes. If we feel that your behavior towards any of our customer care representatives or other employees is at any time threatening or offensive, we reserve the right to immediately terminate your membership and you will not be entitled to any refund.
